Second, and structurally, the voice of the probation service is constrained in a way that restricts access to the media. Probation chiefs are restricted in communicating as leaders of probation by their structural position within NOMS and the oversight of the Ministry of Justice (MoJ). As individual chiefs, they can communicate about local probation issues relevant to their areas, but they do not speak on national policy, which is the domain of NOMS and MoJ. This can be frustrating:

When the National Probation Directorate was set up in 2001, as a government agency, the national director became a civil servant, and so was then bound by the rules of the civil service, not to speak independently. So the probation voice disappeared publicly for a number of years. And that was, I think, probably unexpected; we didn’t anticipate that would happen. We thought having a national voice, a national director would actually focus the voice of the probation service. And it did internally within government, but externally, they were completely unable to say anything. So all the awful things that happened, whether it was cases going wrong or whatever it was, never did you hear anything from the leadership of the probation service at that point … I think, and it’s still the case that, you know, there’s nobody at the centre of NOMS who will be able to say anything around government policy. It can only be done through ministers.
